TERMS AND CONDITIONS OF USE

You must provide your legal full name, a valid email address, a valid credit card or bank account with routing number, and any other information requested in the Boston Broadband Service Agreement as part of the signup process.
You may not use the Service for any illegal or unauthorized purpose.
The Service is billed on a monthly or annual basis depending on your service plan.
Boston Broadband bills in advance of providing service (either monthly or annually.)
Annual residential plans are covered by our 30-day money-back guarantee and are not refundable after 30 days from your activation date.
Boston Broadband will automatically bill your credit card for the total charges indicated on your Boston Broadband service agreement or your online service request. You will receive a paid invoice emailed to the address in your account profile. Your total charges will appear on your monthly credit card statement.
You may change your Service plan and features, and thus your automatic billing authorization, at any time by contacting Boston Broadband. Boston Broadband may terminate service if payment is not received within 30 days of the end of your billing cycle.
Boston Broadband, in its sole discretion, has the right to suspend or terminate your account and refuse any and all current or future use of the Service, or any other Boston Broadband service, for any reason at any time and without notice.
You may terminate your Service at any time by contacting Boston Broadband.
Acceptable Use Policy

Boston Broadband Residential service plans are designed for personal use for 8 hours a day for general internet use including streaming, web surfing, e-mail access, and all other possible online activities. Residential customers are not allowed to host public servers of any kind, use static (public) IPv4 IP addresses, or consume more bandwidth than required to support typical residential Internet activities. Boston Broadband may disconnect or limit the bandwidth for residential customers who use residential service for activities deemed atypical at Boston Broadband’s discretion. Connection speeds for Residential service plans will fluctuate based on network demand. Boston Broadband activates 1 ethernet port in a customer's unit per installation.
Boston Broadband Small Business Plan and Business Internet Services are designed for commercial use 24 hours a day for general internet use including streaming, web surfing, e-mail access, and all other possible online activities. Small Business Plan and Business Internet Services customers are allowed to host public servers and use static (public) IPv4 addresses.  Connection speeds for Boston Broadband Small Business Plan and Business Internet Services customers are not guaranteed and will fluctuate based on network demand.
Boston Broadband Dedicated Circuits are designed for commercial use 24 hours a day for general Internet use including streaming, web surfing, e-mail access, and all other possible online activities. Dedicated Circuit customers are allowed to host public servers, use static IPv4, and consume unlimited bandwidth. Connection speeds for Dedicated Circuit customers are committed information rates and will not fluctuate.
Mail servers designed specifically for the distribution of spam may not be connected to the Boston Broadband network. Any computer on the Boston Broadband network that is involved with spamming software and distributes spam, even without the Owner’s knowledge or consent, may be disconnected from the Boston Broadband network at Boston Broadband’s discretion.
Computers designed specifically for the distribution of viruses or other malicious code may not be connected to the Boston Broadband network. Any computer on the Boston Broadband network that is infected with malicious code and distributes malicious software, even without the Owner’s knowledge or consent, may be disconnected from the Boston Broadband network at Boston Broadband’s discretion.
Computers actively engaged in illegal file-sharing operations may not be connected to the Boston Broadband network. Any computer on the Boston Broadband network that is infected with illegal file-sharing software and distributes copyrighted materials, even without the Owner’s knowledge or consent, may be disconnected from the Boston Broadband network at Boston Broadband’s discretion.
You agree to allow personnel of Boston Broadband and its partner's reasonable access to your site for the purpose of proper maintenance of equipment and, if necessary, you shall obtain appropriate authorization from your landlord.
Boston Broadband Acceptable Use Policy can change without notice. All changes will be published on

BostonBroadband.org before taking effect.
General Conditions
You expressly understand and agree that Boston Broadband shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses (even if Boston Broadband has been advised of the possibility of such damages), resulting from (i) the use or the inability to use the Service; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the Service; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the Service; (v) or any other matter relating to the Service. Where Boston Broadband can be held liable, liability is limited to monthly fees.

Privacy Policy
Boston Broadband is a strong supporter of online privacy and individual rights. Our goal is to provide you with the best possible internet experience. We only collect data necessary to operate our service effectively. Boston Broadband will never sell the information we collect to any third parties.
Boston Broadband cooperates with local and federal law enforcement agencies upon valid request.  
Boston Broadband does not store your data or back up your data other than registration and billing data. 

What information is collected about me?
We collect data you provide us when you sign-up for service. Examples include your name, address, phone, and email address. We use this information to set up your user account. We do not collect data without your knowledge. We use data to continually improve the reliability and performance of the network.

How do you use collected information?
We monitor and collect usage data and session statistics so that we can ensure our architecture is optimized for speed and scalability. Usage data and session statistics are collected anonymously.

How do you handle credit card information?
Boston Broadband collects additional information to process credit card payments for one-time and recurring monthly charges. Examples include credit card type, number, expiration date, CVC code, and billing address for the card. Credit card-related information is stored on our credit card processor’s secured servers.

What security measures do you use to protect my privacy?
Your account information is stored securely with strong encryption.

Will my information be shared with others?
Your personal information or account information will not be shared with anyone, except in cases where information is subpoenaed by law.

How will I be notified of changes to the privacy policy?
Boston Broadband reserves the right to change this Privacy Policy from time to time consistent with applicable privacy laws. When we do change it, we will make a copy of the updated Privacy Policy available to you before it takes effect.

You will be notified of changes by email.
You understand and agree that if you use Boston Broadband Services after the effective date of the updated Privacy Policy, Boston Broadband will consider your use as acceptance of the updated Privacy Policy.

Electronic Communications Privacy Act Notice
Boston Broadband makes no guarantee of confidentiality or privacy of any information transmitted through or stored upon Boston Broadband technology, and makes no guarantee that any other entity or group of users will be included or excluded from Boston Broadband’s network. In addition, Boston Broadband may periodically monitor transmissions over its network for maintenance, service quality assurance, or any other purpose permitted by the Electronic Communications Privacy Act, P.L. No. 99-508, as amended.

To comply with Federal Law and FCC regulations, Boston Broadband tracks repeated offenses of copyright infringement over our network. Boston Broadband reserves the right to suspend and disconnect service for customers who continue to infringe copyright after acknowledged warnings.
